Encore Haus Co LLC - Terms of Service

Welcome to Encore Haus Co LLC (“Encore Haus”, “we”, “our”, or “us”). We provide recommerce concierge services designed to help clients resell, donate, and rehome household items during life transitions.

By accessing or using our services, you (“you” or “Client”) agree to these Terms of Service (“Terms”). THESE TERMS FORM A LEGALLY BINDING AGREEMENT between you and Encore Haus when properly accepted as described below.

1. How These Terms Becoming Binding

These Terms are enforceable under Colorado and federal law when:

  1. Clear Presentation - You are provided these Terms before or at time you agree to our services.

  2. Explicit Agreement - You confirm acceptance by:

    • SIGNING a service agreement that references or attached these Terms; OR

    • Checking a box or clicking “I Agree” if booking services online.

  3. Consideration - You receive our services, and in return, you agree to pay the fees outlined herein or in a separate service agreement.

2. Services Provided

Encore Haus offers, but is not limited to, the following services:

  • Intake, sorting, and cataloging of items for resale or donation

  • Pricing, listing, and managing sales through third-party platforms

  • Donation drop-off or coordination with approved organizations

  • Clean-out assistance during moves, downsizing, or estate transitions

WE DO NOT GUARANTEE that any item will sell, achieve a specific sales price, or sell within a particular time frame.

3. Client Responsibilities

You agree to:

  • PROVIDE ACCURATE INFORMATION about all items

  • CONFIRM LEGAL OWNERSHIP or have documented authority to sell or donate the items

  • ENSURE ITEMS ARE SAFE, CLEAN, AND ELIGIBLE for resale or donation.

  • Communicate promptly with Encore Haus about scheduling and service-related matters.

4. Ownership & Authorization

You authorize Encore Haus to:

  • Transport, list, sell, donate, or dispose of items in accordance with our agreement.

  • Use photographs/descriptions of items for listings or marketing, unless you request otherwise in writing.

5. Fees & Payment

  • SERVICE FEES & COMMISSIONS are detailed in a separate written agreement or invoice.

  • SALES PROCEEDS are calculated after deducting platform fees, shipping, and related expenses.

  • PAYMENT TIMELINE: Proceeds are remitted within 5 to 7 business days after sale completion.

  • LATE PAYMENTS: Any unpaid service invoices WILL INCUR A LATE FEE OF 1.5% PER MONTH ON THE OUTSTANDING BALANCE OR $25.00 PER MONTH, WHICHEVER IS GREATER.

6. Item Handling & Description

  • Encore Haus MAY DECLINE any item for resale or donation at its discretion.

  • Unsold items will be handled as outlined in your service agreement.

  • WE ARE NOT LIABLE FOR LOSS OR DAMAGE beyond our reasonable control, including transit issues or third-party platform actions.

7. Donations

  • Donation receipts are issued by the receiving organization, not Encore Haus

  • WE DO NOT ASSIGN TAX VALUES to donated items; consult your tax advisor.

8. Consumer Review Rights

Under the CONSUMER REVIEW FAIRNESS ACT, you have the right to post honest reviews. We will never include clauses restricting or penalizing lawful reviews.

9. Privacy & Data Handling

In compliance with the Colorado Privacy Act:

  • Encore Haus acts as a SERVICE PROVIDER, processing your personal information solely to deliver agreed services.

  • Data is only shared with partners essential to providing services (e.g. shipping carriers, payment providers, donation centers).

  • YOU MAY REQUEST ACCESS, CORRECTION, OR DELETION OF YOUR PERSONAL DATA at any time by contacting us.

10. Cancellations & Rescheduling

  • You may cancel or rescheduling services with at least 48 HOURS NOTICE.

  • Short-notice cancellations may result in a fee as stated in your service agreement.

11. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • ENCORE HAUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES arising out of our services.

  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU for the services in dispute.

12. Termination of Services

Either party may terminate with written notice. ANY OUTSTANDING BALANCES REMAIN DUE upon termination.

13. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on our website or sent by email. CONTINUED USE OF SERVICES AFTER NOTICE CONSTITUTES ACCEPTANCE of the updated terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the LAWS OF THE STATE OF COLORADO.

Any dispute shall first be submitted to MEDIATION IN DENVER COUNTY, COLORADO with costs shared equally.

If mediation falls within 30 DAYS, EITHER PARTY MAY FILE SUIT IN THE STATE COURTS OF DENVER COUNTY, COLORADO and both parties consent to that jurisdiction.
